An updated version of WSHA member resource Hospital and Law Enforcement Guide to Health Care Related Disclosure (10th edition) is now available. The guide covers situations where protected health information (PHI) disclosure to law enforcement may be permitted or required under state or federal law. Examples include PHI disclosure to law enforcement in the case of court orders, imminent danger posed by a patient, specific injuries (such as gunshots) or crime victims. This updated version includes guidance on the collection and release of information related to immigration status.
This is a WSHA members-only resource. Please contact Kelly Akers if you need assistance logging onto WSHA’s website.
We encourage hospitals to share this guide with privacy officers, legal counsel, and risk management teams. If you have questions regarding information in this guide, please reach out to or Zosia Stanley or Taya Briley. (Zosia Stanley)
